Don’t overlook sending the Connecticut FMLA annual notice; the notice due date is July 1, 2024. Connecticut law began requiring employers to provide an annual notice to employees of their rights under CT FMLA and CT Paid Leave on July 1, 2022. Also keep in mind that since July 1, 2022, new hires are to be given the notice at the time of hire and then again annually. As a practical matter, employers should simply use July 1st as the date to send the notice to all employees to meet the annual notice requirement.
The Connecticut Department of Labor takes the position that annual notice requirement can be satisfied by including the notice in an employee handbook. However, if the handbook is not reissued annually then the notice needs to be provided separately.
Texas Federal Court to Hear Arguments Today on Suspending New FLSA Rule
Arguments being heard today (June 24, 2024) in federal court may decide whether the FLSA exempt overtime threshold increases on July 1st. The salary threshold is poised to increase from $35,568 to $43,888 pursuant to the U.S. DOL’s final rule issued April 23, 2024.
The arguments begin at 1:30 p.m. (CST) in federal court in the Eastern District of Texas. They stem from a motion filed by the State of Texas asking the court to temporarily suspend the rule nationwide while its underlying legality is being adjudicated. The Department of Labor opposes the motion.
It is not clear whether the court will rule on the motion before the July 1st effective date of the rule. If no ruling or stay is issued, the July 1st effective date will remain in place. We will monitor the case and provide an update once a decision is issued. The case is State of Texas v. United States Department of Labor.
