EEOC Releases New "Know Your Rights" Poster for Employers

On October 19, 2022, the U.S. Equal Employment Opportunity Commission (EEOC) released an updated "Know Your Rights" poster, which replaces the previous "EEO is the Law" poster. Unlike previous versions, the new EEO poster provides a QR code by which employees can access information about the process for filing claims of discrimination.


Covered employers (i.e. most employers with 15 or more employees, federal contractors and unions) are required by federal law to prominently display the poster in a conspicuous location in the workplace where notices to applicants and/or employees are customarily posted. The EEOC also encourages employers to post the notice digitally on their websites, especially for those with employees working remotely who may not visit the physical workplace on a regular basis. (Note: The ADA requires notices prohibiting job discrimination be made available in a location accessible to individuals with disabilities that limit mobility).


The new poster includes the following revisions:

  • A "QR" code for applicants or employees to link directly to instructions for filing a charge of discrimination;

  • Clarification that sex discrimination includes discrimination on the basis of pregnancy (and related conditions), sexual orientation and/or gender identity; and

  • Information about equal pay discrimination for federal contractors.
